VapeEscape Terms of Use

Welcome to VapeEscape. These Terms of Use ("Terms") govern your access to and use of the VapeEscape mobile application ("App"), operated by Fedor Iankov ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using VapeEscape, you confirm that:

• You have read, understood, and agree to be bound by these Terms
• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement

If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

VapeEscape is a vaping cessation and habit tracking application designed to help users monitor their vaping patterns, set reduction goals, and work toward quitting vaping. The App provides:

• Puff tracking and counting functionality
• Daily limit setting and progress monitoring
• Statistics and analytics on usage patterns
• Streak tracking and achievements
• Optional premium features through subscription

3. Eligibility

You must be at least 18 years old to use VapeEscape. By using the App, you represent and warrant that you meet this age requirement. We reserve the right to terminate accounts of users who do not meet this requirement.

4. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Subscriptions and Payments

VapeEscape offers both free and premium subscription tiers.

5.1 Free Features

Basic puff tracking and manual limit setting are available for free.

5.2 Premium Subscription

Premium features require a paid subscription. By purchasing a subscription, you agree to the following:

• Payment: All payments are processed by Apple through the App Store. We do not collect or store your payment information.
• Free Trial: If offered, the free trial period is 3 days. Any unused portion of the free trial is forfeited upon purchasing a subscription.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Billing: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• Price Changes: Subscription prices may change. We will notify you of any price changes before they take effect.

5.3 Cancellation

You may cancel your subscription at any time through your device's Settings → Apple ID → Subscriptions. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods.

5.4 Refunds

All purchases are final. Refund requests must be directed to Apple in accordance with their refund policies. We do not have the ability to process refunds directly.

6. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the App, other accounts, or our systems
• Interfere with or disrupt the App's functionality or servers
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated systems, bots, or scripts to access the App
• Misrepresent your identity or impersonate others
• Share your account credentials with others
• Use the App to collect data about other users

7. Health Disclaimer

You acknowledge and agree that:

• The App is not a substitute for professional medical advice, diagnosis, or treatment
• You should consult with a qualified healthcare provider before making decisions about your health
• We make no guarantees regarding the effectiveness of the App in helping you quit vaping
• Individual results may vary based on personal circumstances and commitment
• If you experience health issues related to vaping or nicotine withdrawal, seek medical attention immediately

8. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, software, and the overall design, are the exclusive property of Fedor Iankov and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not:

• Copy, modify, or distribute the App or its content
• Use the App's name, logo, or branding without prior written consent
• Create derivative works based on the App
• Remove any copyright or proprietary notices from the App

9. User Data

You retain ownership of any data you input into the App. By using the App, you grant us a license to use, store, and process your data solely for the purpose of providing and improving the App's services. Our collection and use of your data is governed by our Privacy Policy.

10. Third-Party Services

The App may contain links to or integrate with third-party services (such as Firebase, Apple Sign In, and Google Sign In). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is subject to their respective terms and policies.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS OF CONTENT

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FEDOR IANKOV, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill
• Any damages arising from your use of or inability to use the App
• Any damages arising from unauthorized access to your account or data

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Fedor Iankov and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the App will immediately cease
• Any provisions of these Terms that should survive termination will remain in effect
• You may request deletion of your account and data in accordance with our Privacy Policy

You may terminate your account at any time by deleting your account through the App's settings or by contacting us.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the App shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts located in Tel Aviv, Israel.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date at the top of this page
• Sending you an email notification (for significant changes)

Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fedor Iankov regarding your use of the App and supersede any prior agreements.
